The difference is the pressure put on the neck. In a rear naked choke, all you gotta do is hold the person with the arm. You aren't squeezing, but just applying surface pressure.   4. A firing isn't justice. They harassed him prior to and the reason for his detainment was not just. The procedures for cuffing someone for detainment needs to change. It is unproven they've committed any crime and the current standard for detainment is assault and battery by police. 4-5 guys strangling and grabbing at the limbs of another man is assault and when it results in a death, all of them should face manslaughter because all it would have taken was for 1 of them to say "guys stop it, let's deescalate the situation" and noone did. Mr. Garner resisted and then adrenaline kicked in – Mr. Garners body weight was about a ton (the fight looked like David vs Goliath) and the officer didn't know if he was armed. My advice to police officers in New York: Next time you see a crime, look the other way. If you have to stop and frisk a certain amount of people in a shift, just stop 80 year old white ladies, you won't have problems with them. And nobody will tell you to stop young black men, because that would be racist. In short: Be as good as a problem solver as loyal New York is to you.

  19. I'd like to point out that Mr. Garner was an entrepreneur. There is a demand for single-cigarettes from people who are quitting and others who cannot afford and entire pack. The cops killed him, in a way, to protect the profits of other capitalists. He saw a demand and offered a market. I don't see anything more harmless that happened here. The "law" that people can't sell single cigarettes is rather ridiculous and clearly written by a corporate lobbyist.

    The New York State Criminal Procedure Law does NOT authorized civil arrest. The arrest violated the 4th Amendment to the US Constitution, and the New York State Constitution. Choke-Hold or not, the arrest was unlawful making the death a crime.

    Many Americans seemed to have been so dumbed down that basic fundamentals of American law have been erased from their minds. So I will remind you: A warrantless arrest without probable cause of a CRIME is unlawful. In this case Mr. Garner committed no CRIME.

    If you believe that he did, please cite the criminal law statute that he was in violation of just one second prior to the arrival of Pantaleo, et al.

    So, what constitutes a “Lawful Arrest”?

    An arrest made with a warrant; or one based on probable cause of a crime.
